Welcome to Ask The Appraiser, LLC and its branded membership service, ATA Connect (collectively, the “Service”). These Terms of Service (“Terms”) govern your use of the Service, including all features, services, and content provided by Ask The Appraiser, LLC (“we,” “us,” or “our”) through the websites www.asktheappraiser.com and connect.asktheappraiser.com (the “Websites”).

  1. Acceptance of Terms By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Websites or services offered through the Service. If you do not agree with these Terms, you may not use the Service.

User-Generated Content By posting, uploading, or otherwise submitting content to the Service, you grant Ask The Appraiser, LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service and Ask The Appraiser, LLC’s business operations.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the content you submit and that such content does not infringe on any third-party rights.

  1. Ambassador Program The Ask The Appraiser Ambassador Program involves the appointment of experienced real estate professionals who serve as representatives and moderators of our community. Ambassadors are expected to adhere to the highest standards of professionalism, expertise, and ethics. Ask The Appraiser, LLC reserves the right to remove any ambassador who fails to meet these standards or violates these Terms.
  2. Courses and Educational Content The Service may offer courses and educational content provided by Ask The Appraiser, LLC or third-party partners. By enrolling in these courses, you agree to abide by any additional terms and conditions set forth by the course providers. Ask The Appraiser, LLC does not guarantee the accuracy, completeness, or usefulness of any course materials and disclaims all liability and responsibility arising from any reliance placed on such materials.
  3. User Conduct You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You agree not to use the Service:

a. In any way that violates any applicable federal, state, local, or international law or regulation. b. To transmit any advertising or promotional materials without our prior written consent. c. To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which may harm Ask The Appraiser, LLC or users of the Service. d. To impersonate or attempt to impersonate Ask The Appraiser, LLC, an Ask The Appraiser employee, another user, or any other person or entity.

  1. Third-Party Services The Service may contain links to third-party websites or services that are not owned or controlled by Ask The Appraiser, LLC. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
  2. Termination We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.
  3. Limitation of Liability In no event shall Ask The Appraiser, LLC, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
  4. Indemnification You agree to defend, indemnify, and hold harmless Ask The Appraiser, LLC, its affiliates, directors, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising out of your use of the Service or your violation of these Terms.
  5. Governing Law These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
  6. Changes to Terms Ask The Appraiser, LLC reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect.
